依照大概規範最大行駛速率在每小時二十五公里以下，且車重（不含電池）在四十公斤以下之二輪車輛，為電動自行車，而最大行駛速率可達每小時二十五公里以上的就為需掛牌的電動機車。

最大差別在於速度，所以初期有些不良商人設計車子檢驗為低速度的電動自行車，但有一開關切換或改裝套件可讓車子能跑到時速25KM/H以上。

在電動機車外觀都差不多情形下確實只能以牌照跟測速度來辨別，拿掉車牌頂多可以免掉一些違規行為罰款，一些該繳的稅還是得繳。
