台中市政府與鄉林建設因會展中心BOT案纏訟多年，鄉林提起確認契約法律關係存在之訴，原本二審鄉林逆轉勝，台中市府不服上訴，但最新法院判決出爐，全案發回更審，台中市府再扳回一城。

最高法院判決主文如下「原判決廢棄，發回台灣高等法院台中分院」。判決理由指出，二審對工期認定未詳加審究，進而認為中市府終止契約為不合法，判決違背法令，應予廢棄。

本案早在1月旬即宣判，但未引起關注。國民黨台中市議會黨團今天上午舉行記者會，要求市府公開判決結果。

台中會展中心原本位於台中市七期重畫區，市府採BOT發包，由鄉林建設得標。雙方因完工日期認定不同，纏訟多年，牽涉到4場官司，最重要的鄉林提起契約確認之訴，一審市府勝訴，二審鄉林逆轉勝。

另外，中市府求償2億元二審勝訴，但只賠償2502萬元，中市府已再上訴。雙方互告侵占土方、非法接管等刑事案件，檢察官不起訴。
